Welcome to Forza Drags League (FDL). These Terms of Service ("Terms") govern your access to and use of https://www.forzadrags.com and any related services, features, content, tournaments, memberships, leaderboards, Discord access, and applications (collectively, the "Service"). By creating an account, registering for a tournament, purchasing a membership, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, Community Code, and Tournament Rules. If you do not agree, do not use the Service.

1. Website Use & Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and meet any age and eligibility requirements you confirm at signup. Prize-eligible tournaments may require additional verification. One account per person; duplicate, automated, or fraudulent accounts may be removed without notice. You are responsible for safeguarding your account credentials and for all activity under your account.

2. Intellectual Property

All content on the Service — including the Forza Drags League name, logos, marks, graphics, copy, video, leaderboards, brackets, templates, software, and the look and feel of the site — is owned by or licensed to Forza Drags League and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You retain ownership of race submissions, videos, screenshots, and other content you upload ("User Content"), but grant Forza Drags League a worldwide, royalty-free license to host, store, reproduce, display, adapt, and distribute that content for operating, promoting, and improving the Service.

3. Acceptable Use

You agree not to:

• Scrape, crawl, or harvest any portion of the Service by automated means, including bots, spiders, or headless browsers, without our prior written consent.
• Reverse engineer, decompile, disassemble, or attempt to derive source code for any part of the Service, except where applicable law expressly permits.
• Spam users, chat rooms, comment sections, support inboxes, or any other surface — including unsolicited promotions, referral abuse, mass tagging, or repeated identical messages.
• Abuse other users or staff via harassment, hate speech, threats, doxxing, sexual content involving minors, impersonation, or coordinated brigading.
• Cheat, submit fake or manipulated proof, exploit bugs, share or sell accounts, evade bans, manipulate prize outcomes, or wager on results.
• Upload malware, attempt to overload or disrupt the Service, probe for vulnerabilities without authorization, or interfere with other users' enjoyment of the Service.
• Use the Service to violate any law or regulation, infringe any third party's rights, or transmit content you don't have the right to share.

We may investigate and take action — including warnings, content removal, suspension, permanent ban, or referral to law enforcement — for any violation.

4. Memberships, Payments & Refunds

Founder access is granted during the launch window per the founder terms. Paid memberships renew automatically at the then-current price until you cancel from your billing settings. Taxes and processor fees may apply. Payment processing is handled by our third-party processor (Stripe); you authorize them to charge your selected payment method. Membership payments are non-refundable except where required by law. Users removed for harassment, cheating, botting, fake accounts, abuse, spam, prize manipulation, or rule violations are not eligible for refunds except where required by law.

5. Tournaments, Results & Prizes

Tournaments are skill-based competitions, not games of chance. All results are subject to admin review and may be adjusted or disqualified. Prizes are awarded only to eligible, verified racers after the dispute window closes. Prize-eligible winners may be required to provide tax documentation (e.g., IRS Form W-9 for U.S. residents). Where prohibited by law, the Service or specific prize events are void.

6. AI-Generated Content Disclaimer

Portions of the Service — including blog drafts, summaries, recommendations, chat replies, and certain marketing copy — may be generated or assisted by artificial-intelligence systems. AI output can be inaccurate, incomplete, or out of date. We make no representation that AI-generated content is error-free, and you should not rely on it as professional, legal, financial, medical, or other expert advice. You are responsible for independently verifying any decisions you make based on AI-generated content.

7. Third-Party Services Disclaimer

The Service integrates with or links to third-party platforms, including Microsoft Xbox / Forza Motorsport, Discord, Stripe, Twilio, Google, Meta, Cloudflare, and our hosting and email providers. These third parties operate under their own terms and privacy policies. We are not responsible for their availability, accuracy, content, security, or practices. Forza Drags League is an independent community tournament platform and is not affiliated with, endorsed by, sponsored by, or officially connected to Microsoft, Xbox, Playground Games, Turn 10 Studios, or the Forza franchise.

8. E-Commerce Disclaimer

Memberships and digital goods sold on the Service are licensed, not sold. Descriptions, screenshots, and prize values are approximate and subject to change. We reserve the right to correct pricing errors, limit quantities, refuse or cancel orders, and modify or discontinue offerings at any time.

9. Automotive / Sim-Racing Disclaimer

The Service relates to in-game, simulated racing within the Forza video-game franchise. Nothing on the Service is intended to encourage, instruct, or endorse illegal street racing, dangerous driving, or unsafe modification of real-world vehicles. Always drive lawfully and safely.

10. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT (INCLUDING USER CONTENT, AI-GENERATED CONTENT, OR LEADERBOARD DATA) IS ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORZA DRAGS LEAGUE, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PRIZE OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow these limits, so portions may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Forza Drags League and its affiliates from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.

13. Dispute Resolution & Arbitration

Please contact us first at support@forzadrags.com so we can try to resolve any dispute informally. If we cannot resolve it within 30 days, you and Forza Drags League agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small-claims court if eligible. You and Forza Drags League waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative action. The arbitration shall take place in the State of Texas, or remotely as the arbitrator directs. You may opt out of this arbitration provision by emailing support@forzadrags.com within 30 days of first accepting these Terms.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue there.

15. Termination

We may suspend or terminate your access at any time for any violation of these Terms or for any lawful business reason. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (IP, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law) will survive.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the Service or by email. The version and effective date appear at the top of this page. Continued use of the Service after changes take effect constitutes acceptance.
